Causing Road Fatality

For many years Walsall council systematically neglected their legal responsibilities with respect to maintaining and repairing the roads in their area, the problem became so bad in mid April 2001 that the government threatened to replace the council with a hit squad. Despite numerous complaints to the council about road safety issues and untold damage to vehicles the council continued to ignore their legal responsibilities therefore in early April 2001 David Edgar junior filed 75 legal actions against the council for dereliction of public duty.

Shortly after on the 12th May 2001 a fatal accident occurred in which a young man died when the car in which he was traveling hit a large pot hole in the road causing the driver to loose control, this was the same large pot hole that the council had been warned about prior to the fatal accident .
